1. Agreement to Terms

By accessing or using the Dublyo service, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use our service.

2. Description of Service

Dublyo is a Platform as a Service (PaaS) that provides:

  • Server provisioning across multiple cloud providers
  • Docker-based application deployment
  • AI-powered Dockerfile generation
  • SSL certificate management via Cloudflare
  • Custom domain management
  • 150+ application templates
  • Monitoring and logging capabilities

Application templates consist of Docker Compose configuration files that reference publicly available container images from Docker Hub and GitHub Container Registry. Dublyo does not modify, fork, or redistribute these images.

3. User Accounts

3.1 Account Creation

You must authenticate using a valid GitHub account to use Dublyo. You are responsible for maintaining the security of your account credentials.

3.2 Account Requirements

  • You must be at least 16 years of age
  • You must provide accurate and complete information
  • You must not use the service for any illegal purposes
  • You must not share your account credentials with others

3.3 Account Termination

We reserve the right to suspend or terminate your account if you violate these Terms of Service.

4. Billing and Payments

4.1 Credit System

Dublyo uses a credit-based billing system where 1 credit = $0.01 USD. Server resources are billed hourly based on the server type selected.

4.2 Payments

Payments are processed through PayPal. All purchases of credits are non-refundable. Credits do not expire as long as your subscription remains active. Prices are subject to change with notice.

4.3 Insufficient Credits

If your credit balance is insufficient to cover server costs, your servers may be suspended after a grace period determined by your subscription plan.

5. Acceptable Use

You agree not to use Dublyo to:

  • Violate any applicable laws or regulations
  • Infringe upon intellectual property rights
  • Distribute malware, viruses, or harmful code
  • Conduct phishing or social engineering attacks
  • Mine cryptocurrency
  • Host illegal or prohibited content
  • Launch DDoS attacks or engage in network abuse
  • Attempt unauthorized access to systems
  • Resell services without authorization
  • Disrupt or interfere with the service

Violation of these terms may result in immediate account termination without refund.

6. Content and Data

You retain ownership of all content you deploy through Dublyo. You grant us a limited license to host, store, and serve your applications as necessary to provide the service. You are responsible for maintaining backups, ensuring compliance with applicable laws, and securing sensitive data. All deployed content and data is permanently deleted upon account termination.

7. Third-Party Services

Dublyo integrates with third-party services including GitHub, Hetzner Cloud, Cloudflare, and PayPal. Your use of these services is subject to their respective terms of service and privacy policies.

8. Third-Party and Open-Source Software

Application templates reference container images published and maintained by their original authors. When you deploy a template, your server downloads the image directly from the original publisher's registry. You are responsible for reviewing and complying with all applicable software licenses (MIT, Apache 2.0, GPL, AGPL, BSL, etc.). All product names, trademarks, and registered trademarks referenced in templates are the property of their respective owners.

9. Service Availability

We strive for high availability but do not guarantee uninterrupted access. Support is provided via email on a best-effort basis.

10. Limitation of Liability

To the maximum extent permitted by law, Dublyo shall not be liable for any indirect, incidental, special, consequential, or punitive damages. Our total liability shall not exceed the amount you have paid to us in the 12 months preceding the claim.

11. Disclaimer of Warranties

The service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

12. Indemnification

You agree to indemnify and hold harmless Dublyo from any claims, damages, losses, or expenses arising from your use of the service or violation of these terms.

13. Intellectual Property

Dublyo and its original content, features, and functionality are owned by Dublyo and are protected by international copyright, trademark, and other intellectual property laws.

14. Changes to Terms

We may modify these Terms of Service at any time. We will notify you of material changes by posting the updated terms and updating the "Last updated" date. Continued use of the service after changes constitutes acceptance of the new terms.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the European Union. Any disputes shall be resolved in EU courts.

16. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

17. Entire Agreement

These Terms of Service, together with the Privacy Policy, constitute the entire agreement between you and Dublyo regarding the use of our service.
